General overview of legislative power


The Republic of Slovenia is an EU  Member State implementing the EU acquis communautaire.


Regulation (EC) 1107/2009 defines the procedures for approval of active substances and authorisation of PPPs which are implemented in RS by Regulation implementing Regulations (EC) and (EU) on placing PPPs on the market (UL RS 5/15) and by Plant Protection Products Act (UL RS 83/12) (unofficial English translation).


The distribution and use of PPPs, integrated pest management, PPP application equipment, training of advisors, sellers and users, National Action Plan and other areas of use of PPPs are defined by the Directive 2009/128/EC on sustainable use of pesticides, which is implemented in RS by Plant Protection Products Act (UL RS 83/12). Sustainable use Directive (SUD) referres in its content to pesticides.  It has been intended to cover biocides and PPPs. For the time being it has been used for PPPs only.


Directive 2009/128/EC contains provisions for the inspection of PPP equiment in use, while the requirements for new equipment before they enter the market are defined by Directive 2009/127/EC.  Ministry of economic development and technology is the competent authority for the implementation of this directive.


The fourth regulation important for PPP area, the Regulation (EC) 1185/2009 on statistics of PPPs defines the processing of the data on sales and use of PPPs. The obligation for record keeping is defined by Regulation (EC) 1107/2009 and Directive 2009/128/EC, therefore cooperation between the Statistical office and PPP competent authority is essential.

The competent authority for the implementation of EU legislation and national provisions is the Administration of the Republic of Slovenia for Food Safety, Veterinary and Plant Protection.
